TL;DR

  • Leoni closed its plant in Malošište, Doljevac, laying off approximately 1,900 employees at the end of 2025.
  • This follows closures by Benetton in Niš (over 900 workers), Johnson Electric (over 300 workers), Draxlmaier in Zrenjanin (nearly 2,000 workers), and Kentaur in Vranje (253 workers).
  • Leoni paid severance exceeding the legal minimum, calculated as 50% of the average monthly gross salary for each year of service, which is 50% more than the legal minimum.
  • Severance pay is legally mandated when employment ends due to the cessation of the employer's need for the employee's work (redundancy) or upon retirement.
  • A 'stimulative severance pay' can be offered for voluntary termination, usually higher than the legal minimum.
  • If a company liquidates and ceases to exist, employees are not entitled to redundancy severance pay, as their employment ends due to the employer's non-existence, not redundancy.
  • If a company continues to exist in any form or retains even one employee, it constitutes redundancy, entitling workers to severance pay.
  • Mario Reljanović, a labor law expert, notes that employers can voluntarily pay severance during liquidation, even if not legally obligated.
  • Reljanović confirms Leoni's severance payments were in order because the company continues to operate other factories, meaning it's not a complete cessation of the employer.
  • Legal provisions mandate a minimum of two average salaries for retirement severance and one-third of a salary for each year of service for redundancies.
  • Abuses such as employees being pressured to waive severance, sign false confirmations of payment, or experience delays and incorrect calculations are noted.
  • When employers disappear without settling final wages or unused vacation pay, former employees may face difficulties in claiming their dues.
